China RoHS conformity assessment system implementation arrangement officially released

On May 16, 2019, the implementation arrangement of conformity assessment system for restricted use of hazardous substances in electrical and electronic products (hereinafter referred to as the implementation arrangement) was officially issued by the General Administration of market supervision and the Ministry of industry and information technology. The products that are delivered or imported after November 1, 2019 and listed in the Management Catalogue of hazardous substances in electrical and electronic products (the first batch) (click the blue word to view) shall meet the requirements of the implementation arrangement.

According to the implementation arrangement, the main requirements for the product conformity assessment activities in the Management Catalogue for compliance are as follows:

·Conformity assessment method: for the electrical and electronic products included in the catalogue of compliance management, enterprises should choose the voluntary certification or self declaration method promoted by the state to complete the conformity assessment of the restricted use of hazardous substances in electrical and electronic products. The publication of conformity assessment information and conformity assessment results is managed by the public service platform.

·National promotion voluntary certification: according to the implementation rules of voluntary certification for the restricted use of hazardous substances in electrical and electronic products, enterprises can choose the appropriate certification mode for the products applying for certification. The certification authority will issue the certification certificate after passing the sample inspection and factory inspection results evaluation, and upload the certification result information to the public service platform within 5 working days.

·Self declaration: in accordance with the rules for declaration of conformity of suppliers for restricted use of hazardous substances in electrical and electronic products, the producer or authorized representative shall submit the compliance information to the public service platform within 30 days after the product is put into the market.

·Conformity assessment identification: refer to management measures for use of green product identification for identification requirements.

· Supervision and management: market supervision departments at all levels, industry and information management departments will work with relevant departments to supervise and manage the conformity assessment activities and results. The General Administration of market supervision and the Ministry of industry and information technology will investigate and deal with the reports of violations of this arrangement. The relevant departments will punish the violations in the activities, and the administrative punishment information related to enterprises will be passed through the national enterprise credit letter The information publicity system and public service platform shall be publicized to the public according to law.
